California police arrest a man for driving under influence of caffeine

In August 2015, a California Alcohol Beverage Control agent pulled over Joseph Schwab under the notion that he may be under the influence.

Court documents show the agent claimed Schwab was "weaving in and out of traffic nearly causing several collisions". Inside Schwab's auto, the agent found a number of workout supplements, including powders, but all of them were legal, the station reported.

"The driver seemed very amped up, very agitated, very combative, and she thought he was under the influence of something", Solano County District Attorney Krishna Abrams told KCRA.

Schwab denies the reckless driving allegation and his attorney, Stacy Barrett, says he was arrested despite a preliminary alcohol screening that showed a 0.00 blood alcohol level, according to the Daily Republic.

Over a year after a Northern California man was charged with a DUI, those charges have been dropped, as prosecutors said that they couldn't prove he was under the influence of anything stronger than caffeine.

The charges were dropped more than 16 months after Joseph Schwab, 36, was pulled over on Interstate 680 near Gold Hill Road as he drove to his Fairfield home.

"I was 100 percent confident that I was not under the influence of anything", Schwab said.

On Tuesday, Schwab told KCRA 3 he was anxious no one would believe him.

Making that case with caffeine would be hard, Zehnder said, because the prosecutor would have to show that impaired driving was specifically caused by the caffeine and not any other circumstances.

When asked for a comment on the case, Barrett said, "I've never seen this before; I've never even heard of it". With caffeine a daily habit for many, Edwin Smith believes if anything the substance improves the ability of most drivers.

The statement continued to say the network still plans to tackle serious issues, such as "racism, hatred and violence". I think there's been a disgusting misperception about what it is and what we set out to do.

"This is a case without a blood result, so it makes it a very hard challenge to prove in court", Abrams said.

Schwab grumbled that no officer believed him that he only had caffeine in his system until, lab results showed them.

"If that's the case, then they better come and arrest me", he joked.

For myself and many others' sakes, let's hope this man is cleared of any charge.
